Abu Salem alleges extradition order violation

The TADA court issued a notice to the Madhya Pradesh government based on the gangster’s claims

The Terrorist and Disruptive Activities (Prevention) Act (TADA) court on Friday issued a notice to the Madhya Pradesh government against the allegations made by the underworld gangster Abu Salem (in pic) about the violating of his extradition order. He has been booked in a murder case in Bhopal that did not figure in the list for his extradition.

The gangster moved a plea before the court on receiving a production warrant from a Bhopal court, calling it an illegal detention. The court had issued a notice to the ministry of external affairs to inform the status of the case if it was part of the extradition list.

The ministry informed the court on Friday that the case was not a part of the list of the cases for which the Portugal government had extradited the gangster for prosecution. Sudeep Pasbola, the advocate for the gangster, submitted that Salem has been waiting for the statement and there has been no progress.

“The Bhopal court has issued a production warrant for his custody. For this, make the state a party through its Director General of Police (DGP). If they submit they will not seek his custody, we are fine with it,” Pasbola said.

The special TADA judge GA Sanap then issued a notice to the Madhya Pradesh government through its DGP.

The gangster was extradited by the Portuguese government on September 11, 2005, on the request of the government of India. However, two years after his extradition, in June 2007, the Bhopal court issued a production warrant for Salem in a murder case. Replying to the warrant, the gangster had raised an objection before the court that he cannot be booked.

Sources said the Bhopal court, however, refused to drop the charges against the gangster. The court then asked the Central Bureau of Investigation to submit a reply on the gangster’s plea and issue a clarification on the extradition order. However, the agency failed to take steps and the Bhopal court issue production warrant for the gangster.
