Raze wall around Kanjurmarg dumpyard in 2 months: HC tells BMC

The division bench of chief justice DH Waghela and justice MS Sonak was hearing a petition filed by the BMC which challenged the NGT’s order. The tribunal had observed that the compound wall around the 3,000-tonne bio-reactor plant on the Kanjurmarg dumping ground was illegal and impermissible.

Upholding an order passed by the National Green Tribunal (NGT) in Pune, the Bombay high court (HC) on Friday directed the Brihanmumbai Municipal Corporation (BMC) to demolish the wall it has built around the dumping ground in Kanjurmarg within two months.

The Kanjurmarg facility processes 3,000 metric tonnes (MT) of garbage, and the processing plant could increase its capacity by 1,000 MT by December 2016.

While the civic body admitted to the high court that the wall was built without obtaining permission from the environment department, it contended that the wall was necessary to prevent the dumping ground from being encroached upon.

The BMC said it later applied to the Maharashtra Coastal Zone Management Authority (MCZMA) to have the wall regularised.

It also said that the wall was constructed using funds provided under the JNNURM scheme.
